Terms of Service
These terms govern your use of the Hercules web app and the Hercules ChatGPT app (together, the "Service"), offered by Superpower Studios Inc., a Delaware corporation, d/b/a Hercules ("Hercules", "we", "us"). By using the Service you agree to them. If you use it for a business, you confirm you can bind that business.
Eligibility
The Service is for adults located in the United States.
Accounts
You are responsible for your account, your workspace members, and all activity under them. Keep credentials secure and tell us promptly of unauthorized use.
Credits and payment
- Some actions use credits. You buy credits in advance on the Hercules web app. Payments are processed by Stripe. The ChatGPT app can spend your credits but does not sell them.
- Searches that cost credits are quoted before they run. You are charged only for records actually returned.
- Credits are prepaid, non-refundable except where required by law, and do not expire.
- Credits have no cash value and cannot be transferred outside your workspace.
- We may change prices and credit costs at any time. Changes apply to future purchases and actions, not credits already bought.
Acceptable use
You agree not to:
- Use the Service or its data to make decisions about consumer credit, employment, tenant screening, insurance, or any other eligibility covered by the Fair Credit Reporting Act. Hercules is not a consumer reporting agency and the data is not a consumer report.
- Violate any law when contacting people, including the Telephone Consumer Protection Act, Do Not Call rules, CAN-SPAM, and anti-harassment laws. You alone are responsible for your outreach.
- Stalk, harass, intimidate, or locate a person to harm them, or misuse another person's identity.
- Resell, redistribute or publish raw data in bulk, or build a competing database from it.
- Scrape, reverse engineer, overload, or circumvent limits or security of the Service.
- Use the Service for any unlawful purpose.
We may suspend or limit access if we believe these rules are broken.
Data accuracy
Data comes from public records and licensed third-party data providers and is provided "as is". It may be incomplete, out of date or wrong. Verify anything important with primary sources before relying on it, including legal, title, lending or investment decisions. Nothing in the Service is legal, financial or investment advice.
Your content
You keep rights to the content you add. You give us permission to process it to run the Service. We keep rights to the Service and its software and design.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the extent allowed by law.
Limitation of liability
To the extent allowed by law, Hercules is not liable for indirect, incidental, special, consequential or punitive damages, or lost profits or deals. Our total liability for all claims is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US$100.
Termination
You may stop using the Service and request account deletion at any time. We may suspend or end your access for breach of these terms or to comply with law. Unused credits are not refunded after termination for breach.
Changes
We may update these terms. We will update the date above and, for material changes, notify account holders. Continued use means you accept the changes.
Governing law and disputes
These terms are governed by the laws of the State of Delaware and applicable US federal law, without regard to conflict-of-law rules.
Informal resolution first. Before starting any formal proceeding, contact support@hercules.properties and give us 30 days to try to resolve the dispute.
Binding individual arbitration. Any dispute that isn't resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Consumer or Commercial Arbitration Rules, whichever applies. The arbitration is conducted by one arbitrator, and may be held online or by phone. Either party may instead bring an individual claim in small-claims court, and either party may seek injunctive relief in court for misuse of intellectual property or data.
No class actions. You and Hercules agree to bring claims only individually, and not as a plaintiff or class member in any class, consolidated or representative proceeding.
Opt-out. You may opt out of arbitration by emailing support@hercules.properties within 30 days of first accepting these terms.
Venue. Any claim not subject to arbitration will be brought exclusively in the state or federal courts located in Delaware, and both parties consent to their jurisdiction.
