This policy explains how Superpower Studios Inc., a Delaware corporation, d/b/a Hercules ("Hercules", "we", "us") handles personal data when you use our property-data web app and our ChatGPT app. Questions: support@hercules.properties.
Who this applies to
Our services are offered to adults in the United States only. They are not directed to children, and we do not knowingly collect data from anyone under 18. If you believe a child has given us data, contact us and we will delete it.
What we collect
- Account data: your email address, name, and the workspace you belong to.
- Search activity: the queries and filters you run, and the results you save or view, so we can deliver them and show your history.
- Usage and credit records: a ledger of credits granted, held and spent, with timestamps and which user and workspace they belong to.
- ChatGPT connection: when you connect the ChatGPT app, an authorization record that links your ChatGPT session to your Hercules workspace (access and refresh tokens, stored securely, never shown to you or others).
- Basic technical data: IP address, browser type and request logs, used for security and debugging.
What we do not collect
- Payment card data. Payments are handled by our payment processor, Stripe. We never see or store your full card number. We receive only limited information such as the amount and payment status.
- Government-issued identifiers such as Social Security or driver's license numbers.
- Passwords or credentials for your other accounts, health data, or precise device location.
Property and owner information in results
Search results come from public records and licensed third-party data providers. They can include property details and owner names that appear in public records. We use this information to provide the property research you ask for. The ChatGPT app does not return phone numbers or email addresses for property owners.
How we use data
- To provide, secure and support the service, and to run your searches.
- To meter credits, prevent abuse and fraud, and keep an audit trail of actions on your workspace.
- To communicate with you about your account and support requests.
- To improve reliability and performance. We do not sell your personal data and we do not use it for advertising or behavioral profiling.
Who receives data
- Service providers that host our infrastructure, process payments, and send email, bound by confidentiality and data-protection obligations.
- Data providers. To run a search we send the search criteria (for example a location or a property reference) to our public-records and licensed data providers. We do not send your name or email to them.
- Legal and safety. We may disclose data where required by law or to protect rights and safety.
- Business transfers. Data may transfer as part of a merger or sale, subject to this policy.
How ChatGPT and OpenAI are involved
When you use the Hercules app in ChatGPT, ChatGPT sends the details of your request (such as the search criteria or a property you asked about) to our tools, and we return results to ChatGPT, which shows them to you. Your conversation with ChatGPT is handled by OpenAI under OpenAI's privacy policy. We do not receive your full conversation, only what is sent to our tools. You can disconnect the app at any time (see Support).
Retention
- Account data is kept while your account is active and deleted within 30 days of a verified deletion request, except as noted below.
- Search history and saved results are kept while your account is active.
- Credit ledger and billing records are kept for up to 7 years for accounting and tax purposes.
- Technical request logs are kept for up to 90 days.
- Connection tokens are deleted when you disconnect the ChatGPT app.
Your choices and controls
- View and update your account details in the Hercules web app.
- Disconnect the ChatGPT app at any time from your Hercules account or from ChatGPT settings.
- Request access to, correction of, or deletion of your personal data by emailing support@hercules.properties from your account email. We verify the request and respond within 30 days. Residents of states with privacy laws may have additional rights, which we honor.
- If you are a property owner and want information about yourself removed from our results, email the same address. Where we can, we suppress it. Some information is available in public records outside our control.
Security
We use encryption in transit, access controls that separate each workspace's data, and audit logging of account actions. No system is perfectly secure, so we cannot guarantee absolute security. Tell us promptly about any suspected issue.
Changes
We may update this policy. We will change the date above and, for material changes, notify account holders.
